| Summary, etc. | O constitucionalismo moderno não mais põe em dúvida a força normativa da Constituição e que aos direitos fundamentais correspondem deveres, igualmente fundamentais. Assim, o art. 225 da Constituição Federal de 1988 engloba, de forma híbrida, um direito-dever fundamental vinculado à proteção ambiental e à manutenção do equilíbrio ecológico, reconhecidamente essencial à sadia qualidade de vida humana. Esse dever fundamental de proteção ambiental possui, além de uma dimensão normativo-constitucional, dimensões axiológicas que não podem ser olvidadas pelo intérprete constitucional. Outrossim, embora ainda se apresentem tormentosas as questões referentes à abertura material e à aplicabilidade imediata dos deveres fundamentais, a complexidade das relações ambientais e a fundamentalidade do direito-dever de proteção do meio ambiente exigem do intérprete uma nova hermenêutica constitucional pautada por critérios de solidariedade e justiça entre todas as formas de vida |
