The traditional distinction between public and private spheres is now less certain and more debatable than ever before. Globalisation and the development of private bodies with greater resources than many national governments require that we undertaken the search for a better balance. This development is being taken into account in the new Constitutional era which has dawned in South Africa following in 1994 elections. The courts will, therefore, act as mediators in assessing the exercise of public and private powers and the aspirations of citizens
