520 3 _aIn the Federal Telecommunications Act of 1996, Congress declared the national interest in deregulating telecommunications services and authorized federal preemption of state and local regulations help to create "barriers to entry" to telecomunications market. By 2002, six years after after passage of the act, federal courts had decided a series of cases preempting and overturning local regulation of telecommunications providers. This article reports on the leading cour decisions concerning local telecommunications ordinances that regulate telecommunications service providers. Local governments to affect cable and wireless infraestructure placement and high-speed digital services within their jurisdictions
